Forensic readiness and digital forensics evidence in the Italian court

05 Mar 2019
The talk proposes a comprehensive approach to the management of corporate IT infrastructures through a forensic readiness plan lowered into Italian reality.
Such a proactive approach, also regarding cybersecurity and GDPR, is extremely important in Italy, because of the characteristics of the judicial system (common law vs. civil law) and the common habit among lawyers of repudiating digital evidence. This methodology offers additional legal protection for the suspect or the defendant as well. Italian judges’ typical attitude toward digital evidence will be described, together with an explanation of how expert witnesses operate and how to set up an effective digital evidence management system.
